Welcome to Trahere! The terms "we", "us" and "our" refer to Trahere. By visiting, interacting with or using our website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you should not use or access our services.

IMPORTANT: For any issues, questions, or concerns regarding your orders, returns, refunds, or account, you must first contact our customer service team at simon@atflee.com before taking any other action. We are committed to resolving all customer matters promptly and fairly.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use our services, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent that all information you provide is correct, current and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - CUSTOMER SERVICE AND COMMUNICATION

Contact Requirements: Before initiating any returns, disputes, chargebacks, or legal actions, you agree to first contact our customer service team at simon@atflee.com to allow us the opportunity to resolve your concern.

Response Time: We strive to respond to all customer inquiries within 1-2 business days. For urgent matters, please clearly mark your email subject line as "URGENT."

Communication Channels: Our primary method of communication is email. By using our services, you agree to receive transactional emails regarding your orders, as well as important updates about our policies or services.

Business Hours: Customer service inquiries are typically handled Monday through Friday, 9:00 AM to 5:00 PM EST, excluding holidays.

SECTION 3 - OUR PRODUCTS

We have made every effort to provide accurate representations of our products. However, product colors or appearance may differ from how they appear on your screen due to device settings. We do not warrant that the appearance or quality of products will meet your expectations or match online depictions.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product and may limit quantities available to any person, geographic region or jurisdiction.

SECTION 4 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason. Your order is not accepted until we confirm acceptance and process your payment.

Order Modifications: Please review your order carefully before submitting. Contact us immediately at simon@atflee.com if you need to modify or cancel an order. Once an order has been processed and shipped, it cannot be cancelled and must follow our return policy.

Order Issues: If you experience any problems with your order, contact us at simon@atflee.com before disputing charges or leaving negative reviews. We are committed to resolving all issues fairly.

Your purchases are subject to our Return and Refund Policy.

SECTION 5 - PRICES AND BILLING

Prices and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed. Posted prices do not include taxes, shipping, handling, or customs charges unless expressly stated.

You agree to provide current, complete and accurate purchase and payment information. You represent and warrant that:

  • The credit card information you provide is true, correct, and complete
  • You are authorized to use such credit card for the purchase
  • Charges incurred will be honored by your credit card company
  • You will pay all charges at the posted prices, including shipping and applicable taxes

Billing Disputes: If you believe you have been incorrectly billed, contact us immediately at simon@atflee.com. Do not dispute charges with your credit card company before giving us the opportunity to resolve the issue.

SECTION 6 - SHIPPING AND DELIVERY

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Shipping Issues: If you have not received your order within the estimated delivery timeframe, please contact us at simon@atflee.com with your order number so we can investigate.

SECTION 7 - RETURNS AND REFUNDS

Please refer to our Return and Refund Policy for complete details. All returns must be initiated by contacting simon@atflee.com first. Unauthorized returns sent without prior approval will not be accepted or refunded.

SECTION 8 - INTELLECTUAL PROPERTY

Our services, including all trademarks, brands, text, displays, images, graphics, and design, are owned by Trahere, its affiliates or licensors and are protected by intellectual property laws.

You may use the services for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works without our prior written consent. Unauthorized use may violate intellectual property laws.

SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools or links to third-party websites. We provide these "as is" without warranties or endorsement. We are not responsible for content, accuracy, or your use of third-party materials. Use of third-party tools is at your own risk.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Trahere is powered by Shopify, which enables us to provide services to you. However, all sales and purchases are made directly with Trahere. By using our services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Trahere. You release Shopify and its affiliates from all claims arising from your transactions with Trahere.

SECTION 11 - PRIVACY POLICY

All personal information we collect is subject to our Privacy Policy and Shopify's Privacy Policy. By using our services, you acknowledge you have read these policies. Information may be transmitted to third parties in other countries to provide services to you.

SECTION 12 - USER CONTENT AND FEEDBACK

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute such Feedback for any purpose, including commercial use.

You represent that you own all necessary rights to your Feedback and that it complies with these Terms. We may monitor, edit or remove Feedback that we determine violates these Terms or is otherwise objectionable.

SECTION 13 - ERRORS AND INACCURACIES

Information on our services may contain errors, inaccuracies or omissions related to product descriptions, pricing, promotions, or availability. We reserve the right to correct errors and change or update information at any time without prior notice, including after you have submitted your order.

SECTION 14 - PROHIBITED USES

You may not access or use the services to:

  • Engage in any unlawful or malicious purpose
  • Violate any laws, regulations, or intellectual property rights
  • Harass, abuse, or harm any person
  • Transmit false or misleading information
  • Send spam or unauthorized advertising
  • Impersonate another person or entity
  • Interfere with security features or functionality
  • Collect personal information of others without consent

We reserve the right to suspend or terminate your account if you violate these Terms.

SECTION 15 - DISPUTE RESOLUTION

Informal Resolution Required: Before initiating any formal dispute, arbitration, or legal action, you agree to contact us at simon@atflee.com and attempt to resolve the issue informally for at least 30 days.

Communication of Concerns: Provide us with a detailed description of your concern, your desired resolution, and any supporting documentation. We will work in good faith to resolve the matter.

Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the laws of the jurisdiction where Trahere is headquartered, rather than in court. Each party will bear their own costs.

SECTION 16 - TERMINATION

We may terminate this agreement or your access to the services at any time without notice if you violate these Terms. You will remain liable for all amounts due up to the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

SECTION 17 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that your use of the services will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow disclaimer of implied warranties, so this may not apply to you.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, TRAHERE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR SHOPIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Trahere, Shopify, and our affiliates from any claims, damages, losses, liabilities or expenses (including attorneys' fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or third-party rights
  • Your use of the services

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

SECTION 21 - GOVERNING LAW

These Terms shall be governed by the laws of the jurisdiction where Trahere is headquartered. You consent to venue and personal jurisdiction in such courts.

SECTION 22 - CHANGES TO TERMS

We reserve the right to update these Terms at any time. We will notify you of material changes in accordance with applicable law. Changes will be effective on the date specified in the notice. Your continued use of the services after changes are posted constitutes acceptance of those changes.
